Terms of Service

Welcome to WhyNot. These Terms of Service ("Terms") are a binding agreement between you and WhyNot ("WhyNot", "we", "us", or "our") that governs your use of the WhyNot mobile application and related services (together, the "Service"). By creating an account or using the Service you agree to these Terms and to our Community Guidelines, which are part of these Terms. If you do not agree, do not use the Service.

Our Privacy Policy describes how we handle your personal information. It is worth reading — a dating app knows a lot about you.

1. Eligibility

You must be at least 18 years old to create an account or use the Service. There are no exceptions. We enforce this with a date-of-birth gate, store-level age restrictions, and account removal when we learn a user is under 18.
You must not have been previously banned from the Service, and you must not be prohibited from using the Service under the laws of your jurisdiction.
You must not be required to register as a sex offender under any applicable law.

2. Your Account

You agree to provide accurate information about yourself, including your real age and recent photos of yourself, and to keep it current.
One account per person. Your account is personal to you — don't share it, sell it, or create accounts for other people.
You are responsible for keeping your login credentials confidential and for all activity that happens under your account.
We may suspend or terminate accounts that violate these Terms or our Community Guidelines (see section 9).

3. The Service — and Adrian

WhyNot is a dating service built around an AI matchmaker ("Adrian"). Instead of endless swiping, Adrian helps you build your profile, suggests people you may get along with, makes introductions, proposes real-world date plans (including the "Date Roulette" feature, which picks a spot and time for you), and nudges you to follow through. Every suggestion is exactly that — a suggestion. Whether you meet anyone, and where, is always your decision.

4. AI-Generated Content

Parts of the Service are AI-generated: Adrian's messages, suggested bios and profile text, match introductions, and date recommendations. AI-generated content can be inaccurate, incomplete, or otherwise imperfect — use your own judgment, especially for anything that matters.
If you publish AI-drafted text on your profile, you are responsible for it as if you wrote it yourself. Review it before you publish it.
Do not attempt to manipulate Adrian into producing content that violates these Terms or our Community Guidelines.
Every piece of AI-generated content in the app can be reported from within the app. If Adrian produces something inaccurate, offensive, or unsafe, please report it — a human reviews those reports.
Adrian is an AI and is labeled as one throughout the app. Adrian is not a licensed counselor, therapist, or professional advisor of any kind.

5. Your Content

"Your Content" means everything you submit to the Service: photos, profile text, messages, voice notes, and answers you give Adrian. You retain ownership of Your Content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt (for example, cropping or transcoding), and display Your Content solely to operate, improve, and promote the Service to you and the users you interact with. This license ends when Your Content is deleted from the Service, subject to the retention windows in our Privacy Policy.

You represent that you have the right to share everything you post, and that it does not violate anyone else's rights or any law.
We may screen, moderate, remove, or refuse any content that violates these Terms or our Community Guidelines — including automated photo moderation before a photo becomes visible to others — but we do not guarantee review of all content.
Messages between you and your matches are private to that conversation; we access them only as described in the Privacy Policy (for example, when a message is reported).

6. Community Guidelines & Prohibited Conduct

Our Community Guidelines are part of these Terms and describe in detail what is and is not allowed — including our zero-tolerance Child Safety Standards. In short: be yourself, respect other people, no harassment, no hate, no scams or commercial solicitation, nothing illegal, and absolutely nothing that harms or endangers minors. Violations may result in content removal, suspension, or a permanent ban.

7. Meeting People Is Your Call

We do not run criminal background checks on users. We are not responsible for the conduct of any user, on or off the Service. Exercise the same caution you would meeting anyone new.
Meet in public, tell someone where you're going, and arrange your own transportation. Adrian proposes venues; it cannot vouch for the people you meet or the venues themselves.
Never send money to anyone you meet on the Service, and report anyone who asks — asking other users for money is grounds for removal.

8. Free Service & Ads

WhyNot is free to use. There is nothing to buy in the app, and matching, visibility, and access to other users are the same for everyone.
The Service is supported by advertising. Ads are served by our advertising partner, and what is shared with them depends on the tracking choices described in our Privacy Policy.

9. Suspension & Termination

You may stop using the Service at any time and may delete your account in-app (Account settings → Delete account) or from our account deletion page. Deletion runs on a 30-day grace period during which signing back in cancels it.
We may suspend or terminate your account, or remove content, if we reasonably believe you have violated these Terms or our Community Guidelines, or to protect the Service or its users. The Guidelines describe our enforcement ladder; the most serious violations result in an immediate permanent ban.
Suspended or banned users may not create new accounts. Bans under the Child Safety Standards are permanent and not appealable; for anything else you can contact stump865+thrivesupport@gmail.com and a human will review.

10. Intellectual Property

The Service — including the WhyNot name, the Adrian character, logos, design, and software — belongs to WhyNot or its licensors and is protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the app for its intended purpose. Don't copy, modify, distribute, reverse-engineer, scrape, or build derivative services from it, and don't use automated tools (including AI agents) to access the Service outside its intended interfaces.

If you believe content on the Service infringes your copyright, email stump865+thrivesupport@gmail.com with a description of the work, a link to or description of where the material appears, your contact information, and a statement that you believe in good faith the use is not authorized. We will review and remove infringing content.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT YOU WILL FIND A MATCH, THAT ANY USER'S PROFILE IS ACCURATE, THAT AI-GENERATED CONTENT IS ACCURATE, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. THE SERVICE IS CURRENTLY IN PRIVATE TESTING AND MAY CHANGE, BREAK, OR BE DISCONTINUED.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WhyNot WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — OR ANY LOSS OF DATA, GOODWILL, OR PROFITS — ARISING FROM YOUR USE OF THE SERVICE, INCLUDING THE CONDUCT OF OTHER USERS ON OR OFF THE SERVICE, OR AI-GENERATED CONTENT. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF US $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.

13. Indemnification

You agree to indemnify and hold WhyNot harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from Your Content, your use of the Service, your interactions with other users, or your violation of these Terms or of any law or third-party right.

14. Governing Law & Disputes

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us at stump865+thrivesupport@gmail.com and give us 30 days to try to resolve the dispute informally. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in the Commonwealth of Pennsylvania, and you consent to their jurisdiction.

15. General

Entire agreement. These Terms, the Community Guidelines, and the Privacy Policy are the entire agreement between you and WhyNot about the Service, and replace any earlier agreements.
Severability. If any part of these Terms is found unenforceable, the rest remains in full effect.
No waiver. If we don't enforce a provision, that is not a waiver of our right to enforce it later.
Assignment. You may not assign or transfer these Terms. We may assign them in connection with a merger, acquisition, or sale of assets, or by operation of law.
Survival. Sections that by their nature should survive — including sections 10 through 15 — survive termination of your account or these Terms.

16. Changes to These Terms

We may update these Terms as the product and the law evolve. If a change is material we will notify you in the app or by email before it takes effect. Continued use of the Service after changes take effect constitutes acceptance. The version at this URL is always current.
